I still find it annoying that they put Legolas in the film. But don't get me wrong Legolas is my favourite character and I love Orlando Bloom too. However that being said, if you're not in The Hobbit don't be in The Hobbit.

Although I agree about the abundance of characters making a return in the Hobbit even though they're not practically IN the Hobbit, I think Legolas is an exception. When writing the Hobbit Tolkien hadn't worked out LOTR yet, so he perhaps he hadn't thought of Legolas yet. But given Legolas' age and background, and the fact that his father (although nameless for the first part) does have a significant part, it could very well be that he was actually present during the events with the Dwarves and Smaug.
