i've said all along that heath ledger has only received so many nominations and awards because of his death. regardless of how good his performance is, the joker is not a role that would otherwise have been considered for award recognition. personally, i think it's an insult to him - i havent seen many of his films, but he seems to me to have been a talented and charismatic actor, and i don't think it's fair that (as JF said) he could end up being remembered as "the guy that only won awards becasue he died".
anyway, having seen very few of the nominated films this year (my town only has a very small cinema which shows film on rather a long delay, so most of the films haven't been shown here yet) i can't really make any informed guesses or form any considered opinions as to who should win. having said that, i would love simon beaufoy to win best adapted screenplay for slumdog millionaire - partly because i thought he handled the complicated structure very well, but mainly because he's a local boy (he was born in the next town along from me, and went to school in my town).
also, this way up is a great short animation.

@ TT - The Oscars are this Sunday. It's about 2am over in the UK, but it should be on evening time for you.
LOL! I usually watch it when it has been taped as well. Anytime you can whizz past unfunny people is a great bonus.
One of the best Oscar ceremonies was the ROTK year, because Billy Crystal was hostong and he had little songs about each Best Picture nominee. It was about the time Russell Crowe was in trouble for throwing a telephone at someone and Master and Commander: The Far Side of the World was nominated.

And then Mystic River was also skitted in a song as well as Clint Eastwood who directed it.

Ah, that was a great Oscars. 
@ Phoenix - Well I have to be totally honest and say there are really no actors who have been in films based on comic books that I thought were worthy of an Oscar nomination, let alone an Oscar. I can't say that some of them were not excellent in their roles, but that was pretty much it. I think for the average movie goer who doesn't really know how these characters should be played, the Joker stood out a lot more than the rest both character and performance wise.
Hugh Jackman would look in anything. 
@ ethelfleda - Well I have to say the same thing about Tom Cruise and Robert Downey Jr in Tropic Thunder. Those kind of roles very rarely ever, ever get nominated at any major awards and there is RD nominated for an Oscar! And also it's not as if Heath Ledger being nominated for anything is totally out of the blue, because he's been up for one before.
But really the Academy can't do much right. If they go for elitist films that only three cinemas in the world have shown but the critics love, or if they go for performances that are more main stream and "popular" the other half won't be happy. And then if they have the misfortune to favour someone who is dead, then they're voting with their hearts and not their heads, and if they choose to ignore a deceased person's performance when all the world raves about it (and I think the critics were unanimous about the Joker) then they're being called prejudiced.
It's all very complicated really.

^ but it's film experts judging the awards, so surely it follows that the awards will go to what you call the 'elitist' films that the critics like. the judges shouldn't have to take public opinion into account, because they're industry awards, not viewer awards.
i'm not saying that heath ledger doesn't deserve the award, or that he shouldn't be nominated because batman was a popular film as opposed to highbrow cinema. all i'm saying is that if you look at the way the academy normally votes, it's highly unusual for a film like batman to get a nomination in any of the acting categories. it seems that they're breaking their normal voting patterns because of heath's death, and i don't think that's fair - not on the other actors, and not on heath.
robert downey junior's nod is also something of an anomaly, as was johnny depp's nod for potc but there's always an exception that makes the rule, as the saying goes. i would suggest that robert downey junior has been nominated because they wanted to sort of lighten the mood and add a bit of variety by nominating a comedy performance. similarly, penelope cruz has been nominated for best supporting actress for a comedic role.

Your opinion and I respect it and you.
But as someone who pretty much lives for movies like this. I can honestly say Heath's performance didn't strike me as being any better than the best comic book characterizations. Thomas Hayden Church's portrayal as Flint Marko/Sandman was just as good and intense as anything Heath did in the Dark Knight.

I also think a lot of it has to do with Joker being somewhat of a pop culture icon like Batman and Superman. Spider-Man is to an extent, but his villains aren't.

I've seen on the internet that the winners list as been leaked... I don't what's the point to do this: it only spoils the fun of the most enjoyable ceremony of the year!
Anyway, I give you this link but DON'T CLICK IF YOU DON'T WANT TO KNOW!
And please if you do, don't say anything to those who want to keep a little bit of suspens, play fair!
Let's see if it turns out to be true... For my part, though I read the list because here, in France, the Oscars ceremony is on a crypted channel, I think it's really not cool!

I quite enjoyed the announcement of the best supporting actor, how they had the previous winners introducing the nominees, it was quite interesting and I did love Cuba Gooding Jr talking about Robert Downy Jr. haha, both Jr's... woo!

As everyone is probably aware.... I am so glad that Heath Ledger won.
And I thought the speeches made by his family were dignified and appropriate. They were not too drippy or emotional, and I'm glad of that.
I am so happy for Kate Winslet as well. A little bit embarassing at one point, but what the hey. I loved the reaction from her dad, and it was nice of her to mention the people who have helped her career, even those she hasn't worked with in 15 years.
Totally surprised about Mickey Rourke. I thought he was a dead cert. That was the only upset of the night.
Hugh Jackman was great in his numbers, although the numbers themselves were not as good as normal. He wasn't actually on screen for that much either, it seems in recent years they have been trimming down the ceremony time.
The multiple presenting of the awards was a bit weird really. They were probably just trying something new, but it was cringe worthy when comments were being made about the actors and not that particular performance.
